Possibly son of Andrew WHEATON C of EGGESFORD c 1540-1600

ANDREW. My thoughts,. There are two Andrews on the 1641 Protestation Returns - one in Brushford and one in Nymet Rowland, church records for which no longer exist, so no way of checking further.  Brushford and NR are very near Coldridge. There was an Andrew WHEATON on the Muster Roll 1569 and the 1581 Tax Roll in Eggesford - a mere skip and a jump away. A Peter WHEATON drew up his will in Eggesford in 1587. Since Paul's second child was Andrew, I have made an unprovable assumption that Paul could have been  a son or a nephew of the Andrew in Eggesford.

Information from Susan EKINS April 2006

Philip and Isott were married in Winkleigh around 1800. Philip joined the 40th Regiment of Foot in 1805. His last legal settlement was Culmstock, but was born in Chulmleigh and moved to W. Morchard. Iset, having left him was then examined and the Resettlement and Removals Examinations deported her to Culmstock, the parish being assigned to her as her husband had worked there for the requisite amount of time.

Will of Elizabeth WHEATON née VITTERY formerly BAYLEY.  They had two children George Pretop BAYLEY and Susanna Vittery BAYLEY

 

- to son William WHEATON £100 for him to divide it between Elizabeth's daughter Susan KENNEDY and her children and to pay Elizabeth's Debts and expenses

- for son William to collect rents etc from various properties and to pay grand daughter Mary Lethbridge an annuity of £5 and grand daughter Elizabeth Necrosoff

- to son William WHEATON and his wife £200 to be invested.  The Dividends to be used for the maintenance and upbringing of Elizabeth Necrasoff, the daughter of the grand daughter Elizabeth Necrosoff until the age of 21 when the money should be given to her.  If she dies before the age of 21 the money goes to William and his wife to hold in trust for the great granddaughter Mary Wheaton Necrassoff.  If she dies before she is 21 the £200 goes to William and his wife.

- to William Wheaton and his wife several items of real estate subject to various other bequests which are to come from the rents etc from the properties.   These included the property known as Crews's and the Cross Houses as well as the Interest held in the "Manor or reputed Manor of Brixham".  After the death of William these were to go to Richard CREWSE and William BROWSE  for one thousand years from the date of Elizabeth's death, but they had to allow John Baddley. Elizabeth's grandson to live there for his life.  After his death his sons, "lawfully begotten", one after another, in order are to have hald of the rents from the property.  If no more sons, then the daughters are to share and share alike.  Next the rents are to go to Frederick BADDELY, then his sons (in order) followed by the daughters.  When there are no more daughters the rents were to do to the children of Elizabeth Necrassoff and Mary Lethbridge.  The other half of the rents etc were to go to Frederick BADDELY, then to Richard CREWSE and William BROWSE, then the sons (in order of Frederick BADDELY, then his daughters, then John BADDELY, then his sons and their sons in order, then the daughters, then the children of the grand daughter Elizabeth NECRASSOFF and Mary LETHBRIDGE

- if Richard CREWS and William BROWSE can raise the sum of two hundred pounds, and William Wheaton is dead, then one hundred of it should go to the eldest son of Elizabeth NECRASSOFF and one hundred pounds to the eldest son of Mary LETHBRIDGE.

Notes for William Vittery WHEATON:

In her Will, Elizabeth WHEATON, née VITTERY formerly BAYLEY left most of her property to her son William WHEATON and his wife Elizabeth with the intention that the rents and profits from such properties were to be paid to other members of the family.    John and Frederick BADDELY were also involved with William in carrying out the terms of the Will.  Although monies were left to various Grandchildren, the bulk of the inheritence was to go to Elizabeth NACRASOFF, Elizabeth's great grand daughter, with similar, although not quite as extensive bequests to go to her granddaughter Mary LETHBRIDGE.  William WHEATON was Executor of the Will, and therefore would have been responsible for ensuing that the care and education of these children was carried out.  However, when William died in 1821 (just six years after his mother) his mother's very complicated Will had not been proved.

 

In his Will dated the 25th April 1818 William Vittery WHEATON left the following:

- the house where he lived to his wife Elizabeth, also all Household Good, furnituere, beds, bedding, Table Linen, Plate, China and Glass together with horses, cows and farming implements, together wtih spirits, wines and all other liquors.  She was also to receive £6,000, £3000 to be paid twelve months after William's death and the other £3,000 at the end of two years.  She was also to receive the interest from various securities the the value of £100 for life.

- various properties were left to nephew Samuel LANGLEY and to William BROWN with some restrictions on some of the properties which were to be for the use of other relatives such as Jenney GOODRIDGE, Samuel's sister

- interest on securities were to be paid to Jenney GOODRIDGE, and on her death to her children

- £1,000 went to his sister Susanna KENNEDY's two children Elizabeth and David

- most of the estate was left to John Colwell BADDELEY.  This included 5 houses in Brixham Quay.  Again, there were restrictions concerning use, which included for the benefit of Elizabeth NACROSOFF, sister of John Colwell BADDELEY.

- Mary LETHBRIDGE was left £500 with interest paid yearly.

- Frederick BADDELEY was left £25 a year

- Residue of property and effects to go to John Colwell BADDELEY and Samuel LANGLEY

 

All property left to individuals were to be divided amongst their children when the parents died. 

William also confirmed all the bequests made by his mother in her Will

Information from Susan EKINS 21/10/2012

I have just received copies of apprenticeship/settlement docs. One concerns Nathaniel WHEATON of Winkleigh for  1795 and 1801.

This is the man married to Grace, living in Winkleigh, and dying there in 1812.  According to his attestation he was born in Chulmleigh. This ties him up with the son of Nathaniel, married 1760 and with a son born in 1765. He was apprenticed in Chulmleigh, master moved to Wembworthy, and eventually, with expiry of indentures, after a brief spell back in Chulmleigh, where he married,  he ended up in Winkleigh for the second time

 

Given that the case was still being discussed in 1801 it seems he was not re-settled in Chulmleigh. His wife's father had let him have a cottage in Winkleigh  in exchange for outgoings, including poor rates, and repairs

 

Information from Susan EKINS 16/11/2012

Nathaniel was the subject of two settlement exams whilst he was in Winkleigh. Although the first one, 1795, made the remark that he was of Chulmleigh, it did not look as if he was ever resettled, as he was examined again some years later, and died in Hollocombe, 1815, aged 51. He had a dreadful time of it, one way or the other, what with his master moving to a different village, another being insolvent, getting the smallpox... He married Grace SHORT in Chulmleigh. Grace was the daughter of Richard and Elizabeth SHORT (nee JONAS) and was born in Winkleigh 14.9.1769. According to the examinations, her father helped out with a house, with certain provisos as to payment of rates.

Information from Susan EKINS 16/11/2012

The Examination of Nathaniel Wheaton now resident in the Parish of Winkley in the County taken before us two of His Majesty's Justices of the Peace in and for the County at the George Inn in Hatherleigh on Monday the 2nd Day of March 1795.

 

This examinant on his oath saith he hath heard and doth believe he was born in the Parish of Chulmleigh in this county, At the age of about seven years was bound an apprentice by the churchwardens and overseers of the poor of the said parish to Richard Baker in the said parish till he attained the age of 21 years. At the age of eighteen years his master, Richard Baker, removed from the said parish to the parish of Wemworthy in the said/aforementioned county, in which parish he served out the remaining part of his apprentice with the said Richard Baker, at the expiration of which he went into the parish of Winkleigh aforesaid, and hired himself with Richard Dunnery in the said parish for one year, served that year and received his wages; then went into the parish of Chulmleigh aforesaid and hired himself with Henry Hooper for a month on trial, served the month and then bargained with the said Henry Hooper  to serve him out the remaining part of the year, but at the expiration of about nine months his master Henry Hooper died.  Insolvent, and lost all his wages, the hired himself with James Baker in the aforesaid parish, to serve him till the Lady Day following, which was about six months and ten days, for which he was to have three pounds, but being ill during the time he allowed about three weeks wages for it. At Lady Day he bargained again with the said James Baker to serve him for one year at six guineas. At Michaelmas, or soon after, he married but still continued in service to the end of the year. Then went into the parish of Winkleigh and lived in a house his wife's father gave him to the value of about thirty shillings per annum on condition on his repairing the house and paying the outgoings, which is rated together with another cothouse  (outhouse?)  and some small plots  to the Poor Rate at half a penny pro rata.  That at times he paid his Father in law the rates and at other times hath paid the Overseers of the Poor but is very certain that his name was never on the rate.

 

Note to the effect that it was their opinion that Nathaniel belonged to Chulmleigh.

Information from Susan EAKINS 19/5/2012

I have come to the conclusion that Jane HAMMET who married Thomas was, in fact, a Jane HAMMOND. Research has shown that HAMMET is the "friendly" form of HAMMOND. Her birth place is shown as Iddesleigh on the 1851 census, and her age always tallies with 1761/62. Iddesleigh baptisms showed NO baptisms for HAMMETs for those years but did show the following:

 

Bap. January 14th, 1759        John, son of Richard HAMMOND and Sarah

Bap.September 19, 1760       Betty, daughter of Richard HAMMOND and Sarah.

Bap. September 19th, 1762    Mary, daughter of Richard HAMMOND and Sarah

Bap. July 23, 1764                 Sarah, daughter of Richard HAMMOND and Sarah

Bap September 12th, 1766    Jane, daughter of Richard HAMMOND and Sarah

 

Given the naming traditions, we have the following children of Thomas WHEATON and Jane:

 

Nathaniel (grandfather?), Thomas (father). Elizabeth (could this be Thomas's mother?), John, (this is where my theory isn't quite so straightforward, but might he be for Jane's grandfather?), Richard (mother's father) Sarah (mother's mother) etc etc

 

From this, might we be verging finding Thomas's parents if we looked for a Nathaniel and an Elizabeth? I have had a strong feeling for some while that Thomas's dad was named Nathaniel. This would also support your theory when you describe a certain Nathaniel Wheaton as possibly being his  brother. In this case, his elder brother. Unfortunately, Nathaniel is a VERY popular name among the WHEATONs.

 

Have seen that Nathaniel's eldest daughter was an Elizabeth. If she was named for his mother, then that is another very tenuous link to Thomas being the son of a Nathaniel and an Elizabeth. But all very vague.

of me John Wheaton of Brixham Quay in the parish of Brixham in the county of Devon Mariner made and published this fifth day of November one thousand eight hundred and thirty five first I will and disposed as they may respectively by Deed or Will  direct or appoint notwithstanding their respective coverture and subject as aforesaid   I give and bequeath  my household goods and furniture (But subject to the Estate for life hereinbefore  bequeathed to my said wife and to the use thereof for one month after her decease which her executors or administrators are to have by this my will) and all other my goods chattels monies and securities for money personal and testamontary  Estate and Effects whatsoever unto the said Walter Smith and  Thomas Wood their executors and  administrators upon the following trusts that is to say upon trust to pay apply and dispose of our ninth part thereof to my said daughter Susanna the wife of the said  Moses Tyrer or unto such person or persons and for such uses and purposes as she shall at any time or times or from time to time notwithstanding her coverture by any note or notes writing under her hand direct or appoint  And upon trust to pay apply and dispose of our other ninth part thereof unto my said daughter Agnes the wife of the said  John Dorout or to such person or persons  and for such uses and purposes as she shall at any time or declare that the provision hereby made for the benefit of my said Grandson the said John Wheaton is to be  considered by him in lieu and in discharge of  the money I had of his father's when he died and the interest that has assured thereon as well as of his father's share as one of my children  And it is my will and  meaning that my said Trustees or either of them shall not be liable to answer or make good any loss or losses that shall or may happen to the said Estates or any other thing relating to the execution of the trusts thereby in them reposed unless the same happen by or thro their or either of their wilful neglect or default nor shall either of them be answerable or accountable for the .... goods receipts or disbursomonts of the other of them but each of them for his own separate acts deeds receipts & disbursomonts And I do hereby direct that they my said Trustees shall and may pay and reimburse themselves and himself out of the said trust monies and estates all reasonable and  necessary costs charges and expenses whatsoever that they or either of them shall or may bear pay lay out sustain expound or be put unto in or about the execution of this my will or the trusts hereby in them reposed or in any wise relating thereto  And I further desire that my said trustees will manage and  protect the property of my said three Grandchildren children of my said deceased daughter Jane Jooller during their respective minorities as well as the property of my seven Grandchildren children of my said daughter Elizabeth Ffurze as aforesaid during their minorities and will apply so much of oath one's property as may be requisit for him her or them which shall be allowed  on my said trustees in their amount out of oath  one's respective share  And I do hereby Ann WHEATON née UNKNOWN formerly FURZE was married to William FURZE before she married, as a widow, John WHEATON.  Ann and William FURZE had four children, Ann, William, Thomas (who married Thomas WHEATON son of John WHEATON and his first wife), and James

The Will is long and quite difficult to follow.  However, it would seem that when Ann FURZE married John WHEATON she had property of her own.  There appears to have been a "pre-wedding" agreement between the couple setting out that this property should remain Ann's to dispose of as she pleased.  Much of the Will is concerned with the different amounts of money which either belonged to, or were due to Ann at that time she wrote her will, and which was held by different people, and in different places.

 

In the Will Ann leaves:

- to Grandchildren Ann and Thomas FURZE, children of William FURZE deceased the total sum of £250 to be shared between them

- to Grandchildren Thomas, James Sawyer, Elizabeth Wheaton, Mary Ann, John Wheaton, Salome and William Furze, children of Thomas FURZE and Elizabeth WHEATON the sum of £173 due to Ann from an Indenture of Settlement held by their father, and a further £40 from a Bond held by the Brixham Wesleyan Chapel and now due for repayment.  These amounts were to be shared between the seven grandchildren.

- the residue to be divided in half, with one half shared between the two children of her son William, and the other half to be shared between the seven children of her son Thomas

However, if the children were under 21, the Trustee appointed in the Will were to invest those shares in Securities.
